House probers threaten to jail Paguia for not producing the original audio

LAWYER Alan Paguia must produce the two original audio tapes containing the alleged conversation between President Arroyo and former Elections Commissioner Virgilio Garcillano and identify his source or risk being detained in the House.

This was the warning aired yesterday by Rep. Gilbert Remulla (NP, Cavite), chair of the committee on public information, the lead investigating panel on the wiretapped conversations.

"He is mandated to present the source cassette tapes or face contempt although we’ll consider giving him immunity," he said.

Paguia in radio interview said he could not turn over the two tapes because some of the conversations are considered private, unlike those between Arroyo and Garcillano.

He said that if the joint committee wants to hear the two tapes, it should grant him immunity from RA 4200 or the anti-wiretapping law.

One reason why Paguia left out a lot of stuff is because marami diyan ay hindi naman relevant sa GLORIAGATE scandal, like garci talking to his wife about personal matters na wala namang kinalaman sa "pagpapataas" kay GMA. I think paguia is right to think na this would be an invasion of other people's privacy (the non-guilty ones). You can't just play the taped private conversations of others unless it is RELEVANT AND IN THE INTEREST OF THE PUBLIC. Garci talking to his kabit re meeting her somewhere para makipag-date sila is not important to GLORIAGATE.

I would assume that's paguia's reasoning.

But since somebody suggested na we play the 3 hour tape, o di sige... :D

Pero sana hindi lang Congress ang mag-play ng tape na ito kundi pati na rin yung mga tv stations. They should first authenticate the tape, then play it in it's entirety ("serialized" para hindi mahirap sa viewers at listeners), then let their political, media and audio experts analyze it to educate the public re the contents and the incriminating nature of those tapes.

And oh yeah, the tv and radio networks should provide extensive wall to wall live coverage of the GLORIAGATE hearings from now on. It is their duty to tell the public the truth re what is going on inside the hearings. just like when they covered the corpus accusations vs. lacson or erap's juetengate.

The difference between Samuel Ong and Allan Paguia

The difference between Paguia and Ong is that Paguia knows he could be in legal trouble if he provided parts of the tape that have no relevance to GLORIAGATE, like garci talking re private matters with his wife and kabit. He wants to protect himself from being sued by the non-GLORIAGATE players in those tapes.

Samuel Ong, OTOH, seems to not give a shit. Parang hindi niya masyadong pinag-isipan ang mangyayari sa kanya or the legal troubles he might face. But I'm glad nilabas na rin niya ang tape niya. I just hope that he survives this ordeal (and it will improve when GMA resigns.)

Rep. Prospero Pichay said the opposition would not allow the playing of the source tapes since his sources told him these also contain conversations between an election official and some opposition personalities, two of whom are incumbents.

"Kung ang conversations panay sa majority, the opposition would be willing to play that the whole day," he said.

Matagal na nating alam na there's a possibility that members from both sides (administration and opposition) have talked to COMELEC officials kasi si Mrs. Garcillano mismo ang nagsabi niyan, a few weeks ago.

In itself, it is inappropriate yes, but nothing really serious re talking to comelec officials to complain or inquire.

Ang masama is if a person secretly conspired with a comelec official to rig the elections or silence a witness.

Kaya nga kulang ang "apology" ni Gloria Macapagal Arroyo, kasi she only "apologized" for talking to a COMELEC official. Pero hindi lang naman yan ang kasalanan ni arroyo eh.

We're not asking GMA to resign because she "talked" to a COMELEC official. We are asking GMA to resign because she stole the elections thru cheating by coordinating with a high ranking COMELEC official and the military.

Anyways, if any other official were caught talking in this manner with a COMELEC official, then they should resign too.

Garcillano: Hello.

Barbers: Padre, maniniwala ba sa amin na makakabawi daw dyan sa COMELEC. Humihingi ng binebentang boto. Ano bang gagawin natin dyan.
Garcillano: Sino sa kanila.

UPDATE: Paguia agrees to play all of the tapes

"Yes. We will play the tapes," Paguia said in a telephone interview on the same day.

"I realized that in the interest of the people, we should play the tapes," he said.

Paguia said he no longer feared the consequences of his decision, saying he feels that he has been taken over by events. "Bahala na ang Diyos [I leave it up to God]," he said.

Tee hee, Paguia's vulnerable now. I won't be surprised if Mrs. Garcillano and Garci's kabit will try to sue Paguia for invading their privacy.

UPDATE: Abalos says Enrile, Jinggoy and Jamby Madrigal talked to him

In a phone interview with INQ7.net, Abalos said, “Hindi lang siya. Marami sila [It wasn't only him. There were others]. I cannot remember them all. Maaaring hindi sila, maaaring mga tao nila [It's possible that it's not them, it could have been their people], asking that their votes be counted properly."

"Look, bakit hindi umiimik sina Senator Jinggoy and Senator Madrigal. Tumawag din sila pero walang masama sa tumatawag, wala namang hiningi [Look why are Senator Jinggoy and Senator Madrigal not saying anything. They also called but there is nothing wrong with calling.
