Have you ever heard of "give the person the benefit of the doubt"?

Every Filipino seems to forget that they give a person such as Erap the benefit of the doubt and still he proved to be a vile and corrupt man unworthy of is position as President. Pero tiniis ng mga tao. Ngayon naman sa pagkaka-appoint ni Davide bilang UN Ambassador, you all start acting so self-righteous and pin him as no better than Erap? Binigyan ninyo nga ba siya ng benefit of the doubt gaya ng ginawa ng maraming Pilipino para kay Erap? I doubt in Ellen Tordesillas' eyesight because for her to post such a narrow-minded entry, she must be more myopic than Erap himself. I, myself, have tried giving people like your Cory Aquino, your Susan Roces, your Teofisto Guingona, and your bishops the benefit of the doubt. Sadly, their actions do not speak of their real desire to help the Filipino nation but more to spurn this country and drag it down into hell for their own conveniences. I have seen one too many rallies, one too many tv appearances by these ass-hats who love changing sides as often as Imelda Marcos would change her shoes. At least Davide rigtfully earned the respect that people from the UN are showing him. That people from such agencies as the World Bank and the Asian Development Bank show him until this day. It's so sad to see that the crab mentality of the Filipino is prevalent even among the most educated like you and Miss Ellen Tordesillas. It's people like you who post such hifalutin bullshit on the Internet that make me sorry I was born a Filipino. It's people like Davide, on the other hand, who still give me a ray of hope for people such as yourselves to actually open your eyes and start REAL LEARNING. I doubt most of those who participated in edsa dos gave estrada the benefit of the doubt. the masa maybe, but civil society, i don't think so.

Davide is not worse than erap, although i think the guy is somewhat of a hypocrite and a phony.

And did i give davide and arroyo the benefit of the doubt after Edsa Dos? You bet.

But 5 years after edsa dos, more people now know that your president Arroyo is much more corrupt and worse than erap (not to mention illegitimate as hell), and davide's a partisan SC Justice who's not exactly Mr. Squeaky Clean himself.

If you'll recall, the guy was caught diverting and misusing the Judiciary Dev't Funds that was intended for lowly court employees salaries and benefits to fund Davide and other SC's lavish lifestyles (P120,000 chairs, luxury cars, luxury retirement mansions).

And Davide almost got impeached for that. In fact, at one time, umabot ng 93 ang signatures ng mga congressmen para ma-impeach siya (79 ang required), at naging 88 signatures ang final count. But the partisan Supreme Court came up with a self-serving and prejudiced decision that saved their chief justice's neck.

Besides, the guy should be disqualified because from taking the job because he is past 70 years old already. Under the Foreign Service Law, the age cap for ambassadors is 65. So let's not have another Teehankee here, okay? There are many individuals at the DFA that are MORE deserving and qualified for the position than Davide.

Bakit hindi na lang siya "mag-farming", katulad nang ipinangako niya sa media dati after his retirement?

I doubt in Ellen Tordesillas' eyesight because for her to post such a narrow-minded entry, she must be more myopic than Erap himself.


She criticized erap in the past, and now she's criticizing your president Arroyo and Davide. No wonder corrupt politicians hate her.

You like comparing Davide to Erap, as if being better than erap is such a big deal. As if "being better than erap" makes him qualified for any job. Davide may not be as bad as Erap, but he's hardly the most qualified or deserving person for the UN position either, and I'd rather see someone else represent our country at the UN. Davide presided over one of the most partisan SC since Marcos' time. And the guy shamelessly diverted and used the JDF money that was meant of the court employees for Davide and co.'s own benefit.

And you still dig up old issues. This clearly shows how faulty your reasoning is and how desperate you are to find fault in Davide.

I think it would be better for somebody from the Career foreign service to get the job than davide. I think they're more deserving than davide.

And i've had it with Arroyo appointing her unqualified and way too old allies to lucrative posts as their reward for supporting her. I'm glad the commission on appointments turned down the 77 year old amando doronila appointment as IIRC, EU ambassador. the guy is not qualified and is already to old for the job.

We cannot fault Pacquiao or Precious Lara Quigaman for the way MalacaƱang exploits them. They can always refuse to mouth lines that sound faintly political, but they are not responsible forthe manner in which the state celebrates their achievements. Perhaps, even the bishops don’t have much choice when faced with a request to bless someone who seeks grace.

But other people do. Two friends I respect and admire - former UP president Jose V. Abueva and former Supreme Court Chief Justice Hilario G. Davide, Jr. - had a choice, but both opted to lend their names and reputations to a politician who has done the greatest damage to the nation’s institutions and who continues to govern on the basis of questionable mandate. Dr. Abueva did so by acceoting an appointment as chairman of the Consultative Commission to draft the Constitution. And Justice Davide did so by accepting an assignment as Presidential Adviser for Electoral Reforms.

I cringe each time I see Dr. Abueva beside Ms Arroyo in photo. This is not how I magine a distinguished academic career to end: as a prop to a moribund presidency.

I feel the same way for Chief Justice Davide’s acceptance of his new role as presidential adviser. It breaks my heart. Of the many non-institutional offices invested by past administrations, that of the presidential adviser is the most dubious. At best, it is a usurpation of existing institutional functions. At worst, it serves as a mechanism for political payback, a halfway station for favored individuals on their way to better destinations. Davide has taken on a job worth doing but impossible to do while Ms Arroyo is president.

Can something be more difficult to imagine than electoral reforms under a President who has single-handedly wrecked what remains of the Commission on Elections? He must know Ms Arroyo wants him not so much for waht he can do, but for what he represents in the minds of those who admire him.

He and Manny Pacquiao are but the latest acquisitions of a politician who has mastered the trade in images.

In September, the Commision on Audit came out with a report that found Justice Davide illegally diverting portions of the JDF funds to finance a retirement mansion, luxury vehicles and P120,000 chairs. The article has lots of details about where the money was spent and how much. Read this too.

Supreme Court (SC) Chief Justice Hilario Davide Jr. was yesterday found to have illegally diverted public funds to finance a retirement mansion, luxury vehicles and even overpriced chairs.

Davide, the sole administrator of these special public funds, will have a lot of explaining to do after the Commission on Audit (CoA) yesterday admitted that millions of pesos in funds from the Judiciary Development Fund (JDF), which by law should have gone to the court employees, have been spent instead on buildings, including a Baguio resthouse for retired high court justices, expensive cars and overpriced justices' chairs for their en banc sessions, and all for the exclusive use of Davide and his justices.

This was bared after the CoA submitted to the House committee on justice its partial audit report on the JDF, disclosing that the SC leadership had “diverted” portions of the funds for the procurement of property and other equipment.

Cecilia Caga-anan, supervising auditor of the SC, in her report to the committee, admitted the renovation of the SC session hall and the Baguio cottages was funded from the JDF.

Davide, as chief justice, has the sole authority to disburse JDF funds, but only according to the law covering the JDF, which states that 80 percent of the fiduciary funds are to go directly to the court employees as augmentation of their wages, with 20 percent going to the courts that had contributed to the fund for their renovation and office equipment and supplies.

The law clearly states that the JDF funds cannot be spent for anything else.

Davide stands accused by court employees of gross mismanagement of the JDF.


Moreover, it was also discovered through CoA reports that hundreds of millions in the JDF account remain unaccounted for.

Last year, a total of P32.098 million was spent by the SC using the JDF for the renovation alone of the Baguio facilities or mansions, which were built for the exclusive use of the retired SC justices.

A total of P58.5 million was also spent by the SC using the employees' JDF for the renovation of the high tribunal's session hall.

These brought a total of more than P90 million in funds illegally diverted from the JDF on just the renovation of the facilities.

Based on documents obtained by the Tribune, the high tribunal allotted on Dec. 16, 2002 a total of P32.098 million to Gulf Builders and Development Corp. which Davide contracted to renovate the Baguio cottages, while P56.2 million went to Filipinas Systems Inc., again assigned by Davide, as administrator of the funds, to renovate the SC main building. The remaining P2.3 million was allocated to Siemens (Trans-Asia Phil), a construction management firm.

Apart from these illegal expenses, millions were also spent for the purchase of motor vehicles, 10 of which are luxury cars said to have been intended for the use of the justices of the high tribunal.

The documents also showed that four units of Toyota Super Grandia costing more than a million pesos each were procured on Feb. 28, 2002 , for a total of P4.632 million, again coming from the JDF.

Six more units of Toyota Super Grandia were acquired in April and May for a total of P6.9 million.

While the purchased vehicles were intended for the justices, two motor vehicles were said to have also been purchased for the use of certain employees.

At the same time, P4.285 million for shuttle buses was also disbursed in January 2002. Two months later, another shuttle bus was also acquired for the same amount.

During 2000 and 2001, more than P8 million and 1.7 million, respectively, were spent for the purchases of motor vehicles.

Aside from the infrastructure renovation and motor vehicles, the commission also found that portions of the funds were used to buy executive and clerical chairs.

The details are, however, not quite ready, according to CoA's Caga-anan since the commission “is still preparing a schedule of chairs procured during the period.”

Earlier reports by the Tribune stated that the SC purchased the chairs at bloated prices. The chairs, particularly those used by the justices in their en banc session, were reportedly purchased for P120,000 per piece.

But of course, the COA later changed their tune and denied everything, saying that the JDF funds were not used to fund the construction of retirement mansions, luxury cars and other extravagant items pala.

I'm not surprised by this turnaround. because sooner or later, this admin will get to you, just like what happened to former whistleblower udong mahusay and vidal doble, who changed their testimony at bumaliktad sila after they were ehem... "rescued" by Mike defensor and ISAFP respectively, and accused Lacson (Mahusay) and Samuel Ong/Bishop Ted Bacani (Doble) of kidnapping them raw. LOL.

Or Rashma Hali. She also accused Rufus Rodriguez and Harriet Demetriou of forcing her to make false statements against ARroyo on the election fraud issue:

Harriet Demetriou said she and fellow KNP lawyer, Rufus Rodriguez, had been charged with grave coercion and illegal detention because they were lawyers of the opposition’s presidential candidate Fernando Poe Jr.

“This is political persecution. This is not prosecution,” Demetriou, a former Sandiganbayan associate justice and former Commission on Elections chair, said in a press conference at Club Filipino in Greenhills, San Juan.

The election officer of Tipi-Tipo in Basilan, Hadja Rashma Hali, claimed that Demetriou and Rodriguez had forced her to make an affidavit alleging election anomalies in her hometown.

And the Arroyo's police and CIDG accused both of kidnapping the COMELEC official:

The lawyers of the opposition Koalisyon ng Nagkakaisang Pilipino on Friday withdrew their appearance before the joint canvassing committee to protest the filing of kidnapping charges against two of them by the police....

Sixto Brillantes, one of the KNP lawyers, left the plenary hall after telling the committee of the charges brought by the Philippine National Police Criminal Investigation and Detection Group against Rufus Rodriguez and Harriet Demetriou, the lead counsel.

The CIDG accused Rodriguez and Demetriou of kidnapping a Commission on Elections officer in Mindanao who was supposed to be a witness to an electoral fraud.

Because if you'll recall, before the admin got to Hali, Arroyo at Garci were caught on tape talking about how they were going to silence COMELEC official Hali, at gusto ni Garcillano i-"soft touch" (ipa-kidnap) si Rashma o isang well-meaning na kamaganak niya para bumaliktad siya.

If you actually tried delving into the Supreme Court, malalaman mo na lahat ng mga pera na ginagamit para sa Judicial Reform Project ni Davide ay hindi galing sa JDF. These are GRANTS from other countries who have found Davide's reform program to be the most comprehensive ever undertaken in judicial history and have been more than honored to partner with the Philippines. Alam mo ba kung anong ibig sabihin ng GRANTS? O baka naman sobrang makitid na ang utak mo at hindi mo maintindihan.

Who said anything about "Judicial Reform Project"? Hindi ko naman binanggit yan dito ah! What I have a problem with Davide is his misuse and diversion of the JDF money to build their retirement mansions, luxury cars and extravagant P120,000 chairs.

Iba ang JRP sa JDF. LOL. Let's just stick to the JDF scandal, shall we?

My mother has worked in the Supreme Court for as long as I can remember and because of Davide's care for his employees and his staff, she has not had to worry as much as before about things such as tuition and even miscellaneosu expenses? Alam mo kung bakit?! KASI GINAWANG MONTHLY NI DAVIDE ANG JDF AT THE REQUEST OF SO MANY EMPLOYEES IN THE JUDICIARY, INCLUDING MY MOTHER. Kaya wala kang karapatang gamitin ang isyu na yan laban sa kanya dahil halatang paninira lang siya.

In another related development, court employees, yesterday belied reports they went on mass leave to support Davide.

“The reports are simply not true,” Monete Najera, of RTC Pasig Employees Association, said yesterday.

Najera, and the employees of the regional trial courts of Makati, Mandaluyong and Manila, were in the House yesterday to show support for the lawmakers pursuing the impeachment against Davide.

They said their differential allowances, which used to be around P9,000.00 pesos had dropped to only P2,500.00 to P1,800.00 during the time of Davide.

Nene Rafael, municipal court clerk and vice president for Metro Manila of the Philippine Association of Court Employees, confirmed that employees are “surviving on starvation wages... If not for instant noodles, the court system would have long collapsed because that is the only food we can afford on our salaries.”

“We have many employees [with] a take-home pay of P3,000 a month. If you are the breadwinner, how can your family survive on a P100 a day?” she asked.

Asked to comment on the alleged expensive curtains and chairs for the justices bought with the JDF, Rafael could only shake her head. She said that in their office, she uses a hand-me-down chair. “I bought some nails and glue to fix it.”

re the admin's spin na the JDF's are monthly raw instead of yearly kaya mukhang mababa ang kinikita nila, now why would the court employees complain about that kung mas malaki ang kinikita nila sa monthly (for 12 months combined) back then? Unless, hindi naman talaga ganyan ang sitwasyon dati, or that the combined 12 months jdf is lower than the previous yearly jdf. of course, the pro-davide groups demonized the court employees for going against davide, na "ignorant" raw ang mga court employees na ito dati for complaining about the jdf back in 2003, since "mas mataas" pa raw ang kinikita nila.

(having said that, after napatayo na ang mga mansions sa baguio at nabili na ang mga luxury cars and other items, and after davide survived impeachment, i wouldn't be surprised kung tinigilan na ni davide ang pag divert ng funds after 2003 at bumalik na sa dating levels (o tumaas pa ng konti) and jdfs ng employees. with the increase in taxes this year, i'm sure dagdag pa yan sa sweldo ng mga court employees.)

Cory Aquino once trusted him to be head the Fact-Finding Commission, Cory also appointed him Associate Justice of the Supreme Court. He was also trusted enough to be Chairperson on the Commission on Elections, so no matter what you say, he has a track record to back him up na hindi siya kurakot.

He used to be good. But after Edsa Dos, the guy changed. And many former admirers of his were disappointed. JDF didn't help either.

Former President Estrada revealed that businessman Lucio Tan lobbied for Davide’s appointment as Supreme Court chief justice. He said he was invited by Tan to a dinner in Sheraton Hotel where Davide was waiting.

Admirers of Davide among civil society members, who are strong on ethics among public servants, were silent on the impropriety of Davide asking the help of Tan who has pending cases before the Supreme Court.

Supreme Court (SC) Chief Justice Hilario Davide Jr. and his associate justices may be guilty of obstruction of justice, for deliberately refusing to provide the House of Representatives documents it seeks in an inquiry involving the expenditures of the fiduciary funds.

All clerks of courts and other court personnel have been officially forbidden by the SC chief justice, with the associate justices' approval, to release any and all documents pertaining to the Judiciary Development Fund (JDF).

This was learned yesterday by the Tribune, after having obtained a copy of a signed memorandum dated Oct. 2, 2003, from court administrator Justice Presbiterio Velasco, with an attached en banc resolution from the court, signed by Clerk of Court Luzviminda Puno.

A court insider told the Tribune that this constitutes obstruction of justice, as the justices are aware that the House committee on justice is readying an impeachment complaint which will delve on the disbursements by the Davide Court of the fiduciary fund, which the law creating it states that 80 percent of whatever is remitted to the JDF are to go to the court employees as their augmentation pay, while 20 percent are to be used for office equipment, office renovation, supplies and the like, and by those courts that had remitted the amounts.
